Personal Information means information relating to an identifiable natural or juristic person as defined by POPIA. Processing includes collection, recording, storage, organisation, retrieval, dissemination, deletion, or destruction of personal information. Responsible Party refers to the person or organisation determining the purpose of processing personal information. Operator refers to a party processing personal information on behalf of a Responsible Party. Client Data refers to information supplied by clients during service delivery.
Where clients use our services, we may process employee information, customer information, vehicle information, operational records, contact databases, workflow data, CRM records, communications data, and reporting information. Such information remains under the control of the applicable Client acting as Responsible Party.
Certain services may utilise workflow automations, chatbot interactions, AI-assisted systems, reporting platforms, and integration services. These systems may collect information necessary to perform automated business processes and operational functions.
We may process information for: delivering contracted services, providing support and maintenance, implementing automation solutions, operating DepotTrack, managing client accounts, invoicing and billing, responding to enquiries, website administration, analytics and performance monitoring, security and fraud prevention, legal and regulatory compliance, internal business operations, and improving services and functionality. We process information only where we have a lawful basis for doing so.
Where applicable, processing may be based on contractual necessity, legal obligations, legitimate business interests, client instructions, consent where required, or protection of legitimate interests.
In many engagements, the Client acts as the Responsible Party and Handover acts as the Operator. Clients remain responsible for ensuring that they have lawful authority to provide personal information to Handover for processing. Where Handover determines the purposes and means of processing its own operational information, Handover acts as the Responsible Party.
We do not sell personal information. Information may be shared only where reasonably necessary with: cloud hosting providers, Microsoft services, Google services, Meta platforms, WhatsApp services, ManyChat, Make.com, Supabase, payment processors, professional advisors, regulatory authorities where legally required, and service providers assisting with service delivery. All sharing is limited to what is reasonably necessary for operational purposes.
Certain services may involve processing information outside South Africa. Data may be processed or stored in jurisdictions including European Union member states, United States, or other regions utilised by service providers. By using our services, clients acknowledge and consent to cross-border processing where reasonably required for service delivery. Where required, reasonable safeguards are implemented to protect personal information.
Personal information is retained only for as long as reasonably necessary to provide services, fulfil contractual obligations, meet legal requirements, resolve disputes, enforce agreements, and maintain operational records. Upon expiration of retention requirements, information may be deleted, anonymised, archived, or securely destroyed.
Handover implements commercially reasonable administrative, technical, and organisational safeguards designed to protect personal information, including access controls, authentication protections, role-based permissions, encryption technologies, secure cloud infrastructure, activity monitoring, password management procedures, and security updates and patching. However, no electronic system, internet transmission, cloud environment, or third-party platform can guarantee absolute security. Users acknowledge the inherent risks associated with digital communications and cloud computing.
In the event of a suspected security incident or personal information breach, Handover will take commercially reasonable steps to investigate the incident, contain the threat, mitigate operational impact, restore affected services where possible, and provide notification where required by applicable law. Handover is not responsible for security incidents arising from third-party providers, internet service providers, client-controlled systems, compromised user credentials, or circumstances beyond Handover's reasonable control.
Certain services may utilise automation workflows, AI-assisted systems, chatbot technologies, rule-based processing, and machine-assisted decision support tools. Such systems may process information automatically to perform operational functions. Automated systems may occasionally generate incomplete, delayed, or inaccurate outputs. Clients remain responsible for reviewing and validating critical operational, legal, financial, or customer-facing decisions. Handover does not guarantee the accuracy or suitability of automated outputs.
Subject to applicable law, individuals may have rights to access personal information, request correction of inaccurate information, request deletion where legally permissible, object to certain processing activities, withdraw consent where consent is the legal basis, and lodge complaints with applicable regulatory authorities.
